Katherine specialises in property, construction and professional indemnity disputes. She is recognised as a leader in Chambers.
Katherine leads the property disputes team within the dispute resolution group. This team acts for both landlords and tenants, owners and occupiers, development and property management companies on the full range of property related disputes. In addition, Katherine deals with complex and high value construction related disputes, which often involve a number of parties. She has experience of conducting proceedings in the TCC as well as experience of alternative dispute resolution.
Katherine also acts for professional indemnity insurers for a range of professionals. She defends claims against solicitors, accountants and construction professionals including surveyors, architects and engineers. In addition she provides advice on policy issues.
Her significant cases include:
- Cabvision Ltd v (1) Feetum (2) Marsden (3) Smith (4) Dean & Dean [2009] EWHC 3400 (Ch). Successful defence of solicitors in a claim for £5m arising out or a complex commercial transaction.
- Shepherd v K S Tan & Co [2006] EWHC 768 (Ch). Contribution claim against an accountant arising from advice given immediately prior to a company insolvency. Summary judgment was obtained on the basis that the losses sought were not ‘the same damage’.
- defending a quantity surveyor against a claim brought by his former client for £10m in relation to the refurbishment of a luxury hotel.
- advising tenant on the enforceability of a non-competition clause in a lease and a possible injunction.
- conducting possession proceedings for a landlord where the tenant was claiming a life tenancy based on an estoppel argument.
