The Henmans professional indemnity team has particular experience of advising on claims involving accountants, auditors, pension professionals and financial advisers.  The breadth of our work ranges from complaints before the ombudsman to negotiating settlements at mediation to defending high value claims at trial.  We offer a high standard of service, but at lower rates than London firms, thereby allowing costs to be kept proportionate to the amount in dispute.  In addition, we have significant experience of advising on policy coverage

Examples of our recent cases include:


Accountants

  • Defending an accountant in a £6m contribution claim arising from alleged negligent advice in relation to the pending insolvency of a client company.  We successfully pursued an application for summary judgment.
  • Advising an accountant in relation to a substantial claim for negligent capital gains tax advice on the disposal of a valuable business
  • Acting on a claim in relation to a failure to advise on the availability of certain income tax reliefs over a 6 year period

Auditors

  • Acting for an auditor in a £1m+ claim arising from the alleged negligent audit and preparation of company accounts.  Successfully defended at trial

Pension Schemes

  • Advising on series of claims against a pension scheme administrator in relation to an alleged misapplication of moneys to the employees’ fund
  • Acting on a £1m+ claim by a group of claimants who had been advised to leave a group pension scheme in favour of a personal money purchase scheme

Financial Advisors

  • Defending multiple claims against a retained financial advisor and employer arising from investments totalling over £3m into split capital investment schemes and the collapse of the ‘Splits’ market post 9/11.
