Advice in respect of the environmental issues in connection with the disposal of land and the continuing liability of farmers and landowners who have caused or knowingly permitted contamination of their land; the drafting of warranties and indemnities in conjunction with environmental assessments in order to limit this liability.
Acquisitions
Advice in respect of environmental matters on the acquisition of land in order to limit the likelihood of an unsuspecting buyer acquiring a liability for contaminated or polluted land.
Remediation notices
Advising farmers and landowners following the service for remediation notices in respect of the pollution of water; the contamination of soil; together with advice in respect of the waste management licensing regulations; and advice in respect of such matters generally.
Environmentally Sensitive Areas
Advice on the location of ESAs, applications to DEFRA and the obligations of landowners and occupiers under such agreements.
Agreements with Natural England and the Forestry Commission
We deal with Countryside Stewardship Schemes, Entry Level and Higher Level Stewardship Schemes and Woodland Grant Scheme agreements. When acting in relation to a sale or purchase of land affected by any of these agreements we ensure appropriate indemnities are given, transfer obligations are addressed and future payments are made to the correct party. We also consider the impact of current and possible future agreements when drafting farm business tenancies.
