Duncan is joint head of the firm’s dispute resolution department with Sarah Foster.  He has over 19 years experience of advising on professional indemnity matters. He is recognised as a leader in Chambers and Legal 500. 

Duncan has extensive experience of acting for legal, construction and finance professionals and their insurers, often on complex and high value claims.  He has experience of group litigation and regulatory investigations.  He frequently advises on insurance policy coverage. 

Duncan’s significant cases, many involving multi-million pound claims, include:

  • Extensive involvement in lender litigation of the early 1990s and more recently, including numerous cases involving mortgage fraud and identity theft.
  • Dealing with claims arising out of failed commercial transactions and investments (including “split capital investment” funds and film finance) and failed litigation.
  • Advising on policy issues including notification, scope of cover, exclusions including dishonesty, successor practices and aggregation.
  • Acting for a group of some 170 firms on claims arising from building society “shared ownership” schemes (Halifax v Gould & Swayne & others, CA, 1998).

Duncan qualified in 1991 and joined Henmans in 2006.  He was appointed as joint head of the dispute resolution department in 2007.  Prior to that, he spent 14 years at Beachcroft in London, where he was a partner from 2000.
