Charities free to operate commercially

Described as one of the most scrutinised, non-controversial Bills of all time, the Charities Bill finally received Royal Assent on 8 November 2006. The Charities Act 2006 is now law and will provide a modern legislative framework for the charitable sector.

The Act brings some welcome provisions and will enable charities to operate more freely in an increasingly commercial environment. Alison Talbot, joint head of Henmans’ charities practice was delighted by the news and confirmed:

"For over two years there has been a degree of uncertainty among charities about the impact of the impending legislation. The announcement that the Act is now law will give our clients reassurance and clarity. The Act will give charities increased flexibility in meeting the demands of beneficiaries and donors. There are parts of the Act which may present short term challenges for some charities but these should be embraced as an opportunity to review and adapt to the demands of society."

The timetable for the introduction of the Act will be announced by the Office of the Third Sector in due course. A more detailed summary of the Act will appear on our website shortly.
