Business structures

We are expert at advising on the various different business structures available for landowners and farmers.

Farm partnerships

This includes both family and commercial farming partnership agreements, which are agreements entered into by partners carrying on a farming business with a view to profit. We can advise on negotiating and drafting such agreements and on subsidy, agricultural tenancy and tax matters.

Share farming agreements

These can be varied and flexible arrangements for the farming of land involving separate parties sharing rights and obligations leading to shares in gross returns.

Contractor agreements

These are arrangements between landowners and contractors whereby the contractor carries out acts of husbandry and maintenance in return for a payment, but does not partake in actual profit.  We can draft these agreements to include terms that, if carried out in practice, can yield beneficial determinations by HM Revenue & Customs in relation to IHT liability on death.
